NAR Settlement
New Rules Effective August 17th 2024
What it means for Home Sellers

The new rules were agreed to by the National Association of Realtors as part of a settlement into antitrust claims. The changes are designed to improve transparency around how compensation is handled and approved.

Here is what the settlement means for home sellers:

  • You still have the choice of offering compensation to buyer brokers. Many sellers consider this a way of marketing their home and increasing buyer demand.
  • Your agent must conspicuously disclose to you and obtain your approval for any payment or offer of payment that a listing broker will make to another broker acting for buyers.
  • This disclosure must be made to you in writing in advance of any payment or agreement to pay another broker acting for buyers, and must specify the amount or rate of such payment.
  • If you choose to approve an offer of compensation, there are changes to how this can happen.
  • You as the seller can still make an offer of compensation, but your agent cannot include it on a Multiple Listing Service (MLS).
  • Your agent can advertise your listing via off-MLS platforms such as social media, flyers and websites.
  • You as the seller can still offer buyer concessions on an MLS (for example, concessions for buyer closing costs).
We’ll explain your best options for your neighborhood and price point — so you stay competitive while staying in control.
Fast Home Selling
Tips
  • 1. Hire a professional listing agent. Your strategy, exposure, and negotiation matter more than ever.
  • 2. Declutter and depersonalize. Buyers need to picture themselves living there.
  • 3. Handle obvious repairs and maintenance. Remove “reasons to negotiate.”
  • 4. Stage and style for light, flow, and first impressions.
  • 5. Minor updates + fresh landscaping can increase perceived value quickly.
  • 6. Price competitively. Price creates momentum — momentum creates offers.
  • 7. Use the full digital marketing package below. It expands reach and increases showing quality.

We use
3D

We use 3D to help sell your home. A Matterport® tour gives buyers a true sense of space with a dollhouse view, floor plan view, and a walk-through experience — which often reduces wasted showings and attracts more serious buyers.

Selling Cost
What to expect
  • 1. Realtor fees
  • 2. Attorney fees
  • 3. Florida documentary stamps
  • 4. Repairs or credits after inspection (if any)
  • 5. Paperwork / closing processing items
  • 6. Owner’s title policy (per area custom)
  • 7. Unpaid property taxes (paid in arrears; prorated through closing day)
Power, Water, Insurance, Pool Service, Home Watch, Alarm Monitoring Services
Services Termination

Upon closing, these services will need to be terminated by the Seller. Some providers (like FPL and water) may transfer service to the buyer automatically and notify you. You may need your settlement statement to request prorations or credits from certain services.

Transaction Broker, limited representation to facilitate the transaction.
Representation

In Florida, you are considered a Transaction Broker unless you disclose otherwise. When working with sellers, transaction broker status is often used to facilitate the transaction. Limited representation means that a buyer or seller is not responsible for the acts of the licensee. Additionally, parties give up rights to undivided loyalty. This allows a licensee to assist both sides without working to the detriment of either party.
